MiCard, LLC, a wholly owned subsidiary of American Dream Project, LLC, dba MiWare ("MiCard," "Company," "we," "us," or "our"), respects the privacy of our Users and recognizes the importance of protecting personal information.

This Privacy Policy explains how MiCard collects, uses, processes, discloses, protects, and retains personal information when you access or use the MiCard Platform or MiCard Services.

For purposes of this Privacy Policy, the "MiCard Platform" and "MiCard Services" collectively include MiCard.io and other MiCard-operated websites, mobile applications, SaaS services, MiCard and MiLink pages, CRM functionality, AI and automated functions, APIs, integrations, communications tools, content-generation tools, contact-management functionality, digital identity and networking tools, subscription functionality, and related services and features.

By accessing or using MiCard Services, you acknowledge the practices described in this Privacy Policy.

1. Scope of This Privacy Policy

This Privacy Policy applies to personal information processed through the ordinary MiCard Platform and MiCard Services.

It applies to information concerning:

  • visitors to MiCard websites;
  • MiCard account holders;
  • subscribers;
  • users of MiCard mobile applications;
  • users of MiCard, MiLink, CRM, AI, communications, and content-generation functionality;
  • individuals who communicate with MiCard;
  • individuals whose information is lawfully provided to MiCard by a User through CRM, contact-management, networking, or related functionality; and
  • participants in MiCard.io affiliate or referral functionality where applicable.

This Privacy Policy does not replace separate privacy notices, agreements, or disclosures that may apply to a distinct service, transaction, regulated activity, or program.

2. MiCard.io and the MiCard.co Brand Ambassador Program

The ordinary MiCard.io Platform is separate from the MiCard.co Brand Ambassador program.

Participation in the Brand Ambassador program is voluntary and is not required to use ordinary MiCard Services.

Brand Ambassadors may be required to provide additional information in connection with their separate business relationship with MiCard, including information necessary to administer compensation, tax reporting, compliance, sponsorship, and other Brand Ambassador program obligations.

Information processed specifically in connection with the Brand Ambassador program may therefore be subject to additional agreements, disclosures, Policies and Procedures, or legal requirements applicable to that separate relationship.

Nothing in this Privacy Policy is intended to merge the ordinary MiCard.io User relationship with the separate Brand Ambassador business relationship.

3. Information We Collect

The information MiCard collects depends on how you interact with the MiCard Platform, the features you use, the information you choose to provide, and the services you purchase.

The categories below describe the types of information that may be processed through MiCard Services.

3.1 Account and Registration Information

When you create or maintain a MiCard account, we may collect information such as:

  • name;
  • username;
  • email address;
  • telephone number;
  • mailing or business address;
  • profile information;
  • account preferences;
  • account credentials;
  • authentication information; and
  • other information you provide when registering or maintaining your account.

You are responsible for keeping your account information accurate and current.

3.2 Profile, MiCard, MiLink, and Digital Identity Information

MiCard allows Users to create and manage digital identity, networking, profile, and link-based content.

Depending on the features you use, information may include:

  • professional or business information;
  • company name;
  • job title;
  • biography;
  • profile photograph or image;
  • social-media links;
  • website links;
  • telephone numbers;
  • email addresses;
  • business contact information;
  • custom links;
  • files, images, videos, or other content;
  • calls-to-action; and
  • other information you choose to display or share.

Information that you intentionally publish through a public-facing MiCard, MiLink, profile, page, or similar feature may be visible to other people.

Do not publish information that you do not want others to view.

3.3 CRM, Contact, and Networking Information

Certain MiCard Services may allow Users to enter, upload, import, organize, store, or manage information concerning contacts, prospects, customers, clients, colleagues, or other individuals.

This information may include:

  • names;
  • email addresses;
  • telephone numbers;
  • company information;
  • professional information;
  • notes;
  • relationship information;
  • interaction history;
  • tags;
  • communications;
  • scheduling information;
  • lead or contact status; and
  • other information supplied by the User.

Users are responsible for ensuring that they have the appropriate authority, permission, or other lawful basis to provide personal information concerning other individuals to MiCard.

Users may not use MiCard Services to unlawfully collect, upload, purchase, scrape, harvest, process, or communicate with individuals.

4. User Content and Communications

MiCard may process information you create, submit, transmit, store, or receive through the MiCard Platform.

This may include:

  • messages;
  • emails;
  • text or other communications;
  • notes;
  • documents;
  • photographs;
  • images;
  • videos;
  • recordings;
  • files;
  • reviews;
  • comments;
  • questions and answers;
  • generated content;
  • form submissions; and
  • other User-supplied materials.

The content processed depends on the MiCard Services you choose to use.

Personal information contained within User Content remains subject to this Privacy Policy and applicable law.

5. AI and Automated Features

Certain MiCard Services may include artificial-intelligence, generative, automated, recommendation, transcription, summarization, drafting, content-generation, or similar functionality.

When you use those features, MiCard may process:

  • prompts;
  • instructions;
  • content supplied for analysis;
  • text;
  • files;
  • contact or CRM information submitted to the feature;
  • generated outputs;
  • feedback;
  • usage information; and
  • related technical data.

You should not submit sensitive or confidential information to an AI feature unless you are authorized to do so and the feature is appropriate for that information.

Where MiCard uses third-party technology providers to support AI or automated functionality, information may be processed by those providers solely as necessary to provide the applicable functionality and subject to applicable contractual and legal protections.

MiCard may use information concerning the operation and performance of AI features to maintain, secure, troubleshoot, and improve the MiCard Services.

6. Subscription, Transaction, and Payment Information

When you purchase a MiCard subscription, product, or paid service, information associated with the transaction may be processed, including:

  • name;
  • billing address;
  • subscription selected;
  • purchase amount;
  • transaction date;
  • billing status;
  • renewal information;
  • payment-method type;
  • payment-related identifiers; and
  • transaction history.

Payment-card transactions may be processed through third-party payment processors or application marketplaces.

MiCard may receive information concerning the status of a payment or transaction without receiving or retaining the full payment-card number.

Purchases made through Apple, Google, or another marketplace may also be subject to that provider's privacy practices.

7. Information Collected Automatically

When you interact with the MiCard Platform, certain technical and usage information may be collected automatically.

This may include:

  • Internet Protocol address;
  • device type;
  • operating system;
  • browser type;
  • application version;
  • device identifiers;
  • login activity;
  • pages, screens, or features accessed;
  • dates and times of activity;
  • referring or exit pages;
  • error and crash information;
  • performance information;
  • approximate location derived from IP address;
  • network information; and
  • other diagnostic or usage information.

MiCard may use this information to operate, secure, maintain, analyze, troubleshoot, and improve the MiCard Platform.

8. Cookies and Similar Technologies

MiCard websites and web-based Services may use cookies, local storage, pixels, software-development kits, or similar technologies to support functionality and understand Platform activity.

These technologies may be used to:

  • keep Users signed in;
  • remember settings and preferences;
  • maintain security;
  • prevent fraud;
  • understand Service usage;
  • measure performance;
  • diagnose technical issues; and
  • improve Platform functionality.

Where required by applicable law, MiCard will provide appropriate choices or consent mechanisms concerning non-essential cookies or similar technologies.

Browser settings may permit you to restrict or delete certain cookies, although doing so may affect Platform functionality.

9. Information From Third-Party Integrations

MiCard Services may allow you to connect third-party accounts, services, APIs, platforms, or applications.

When you choose to enable an integration, MiCard may receive or send information as necessary to provide the integration.

The types of information processed depend on:

  • the third-party service;
  • the permissions you authorize;
  • the functionality requested; and
  • the information available through the integration.

You are responsible for reviewing the privacy practices and permissions of third-party services before connecting them to MiCard.

You may be able to disconnect an integration through MiCard or the applicable third-party service.

10. Information You Provide to Support or Compliance

When you communicate with MiCard support, compliance, billing, or other Company personnel, we may collect information including:

  • your name;
  • contact information;
  • account information;
  • correspondence;
  • support requests;
  • complaints;
  • documents;
  • screenshots;
  • transaction information; and
  • other information necessary to investigate or respond to your request.

MiCard may retain support and compliance communications as reasonably necessary for customer service, dispute resolution, recordkeeping, security, and legal compliance.

11. How We Use Personal Information

MiCard may use personal information for the following business and operational purposes:

11.1 Providing the Services

  • create and administer accounts;
  • provide MiCard and MiLink functionality;
  • provide CRM and contact-management features;
  • operate AI and content-generation tools;
  • provide communications functionality;
  • process subscriptions and transactions;
  • provide integrations;
  • authenticate Users;
  • maintain account preferences; and
  • otherwise provide features requested by Users.

11.2 Operating and Improving MiCard

To:

  • maintain the Platform;
  • troubleshoot issues;
  • monitor performance;
  • diagnose errors;
  • develop improvements;
  • test functionality;
  • understand how Services are used; and
  • improve User experience.

11.3 Communications

To communicate with you regarding:

  • your account;
  • purchases;
  • subscriptions;
  • billing;
  • renewals;
  • security;
  • support;
  • service changes;
  • product updates;
  • administrative matters; and
  • other MiCard-related information.

Where required by law, marketing communications will be sent only with the required permission.

11.4 Security and Fraud Prevention

To:

  • authenticate accounts;
  • identify suspicious activity;
  • prevent unauthorized access;
  • investigate security incidents;
  • enforce account restrictions;
  • prevent fraud or abuse;
  • protect Users; and
  • maintain the integrity and security of the MiCard Platform.

11.5 Legal and Compliance Purposes

To:

  • comply with applicable law;
  • respond to lawful requests and legal process;
  • investigate alleged violations;
  • enforce agreements;
  • protect MiCard's rights;
  • resolve disputes;
  • maintain required records; and
  • cooperate with regulators, courts, law enforcement, or other governmental authorities where legally required.

12. How We Disclose Personal Information

MiCard recognizes and respects the importance Users place on the privacy of their personal, account, and financial information.

MiCard may disclose personal information only as reasonably necessary for the purposes described in this Privacy Policy, as authorized by the User, or as permitted or required by law.

Categories of recipients may include the following.

12.1 Service Providers

MiCard may use third-party vendors and service providers to support functions such as:

  • hosting;
  • cloud infrastructure;
  • data storage;
  • payment processing;
  • customer support;
  • communications;
  • email delivery;
  • security;
  • analytics;
  • application functionality;
  • AI functionality;
  • integrations;
  • billing; and
  • other operational services.

Such providers may receive information only as reasonably necessary to perform services for MiCard, subject to applicable contractual and legal obligations.

12.2 Third-Party Services You Choose to Use

If you direct MiCard to connect with or share information through a third-party service, integration, platform, API, application, or other recipient, MiCard may disclose information as necessary to fulfill your instruction.

Information disclosed to an independent third party may then be governed by that third party's privacy policy.

12.3 Public Information

Information you intentionally publish through a publicly accessible MiCard, MiLink, profile, page, link, directory, or similar feature may be accessible to other people.

MiCard cannot control how another person uses information that you have intentionally made public.

12.4 Legal Requirements and Protection of Rights

MiCard may preserve or disclose personal information when reasonably necessary to:

  • comply with applicable law;
  • respond to a subpoena, warrant, court order, or other lawful process;
  • respond to governmental or regulatory requests;
  • investigate fraud or unlawful activity;
  • protect the security of MiCard;
  • protect Users or other individuals;
  • enforce agreements;
  • establish, exercise, or defend legal claims; or
  • prevent serious harm.

12.5 Business Transfers

If MiCard or its business is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, change of control, or similar transaction, personal information may be disclosed or transferred as part of that transaction.

Any successor receiving personal information will be required to handle the information in accordance with applicable law and any privacy commitments that remain legally binding.

13. Brand Ambassador Information

Brand Ambassadors participate under separate agreements from ordinary MiCard.io Users.

In connection with the Brand Ambassador relationship, MiCard may process additional information required to administer that separate program.

The attorney-approved Policies and Procedures contemplate information including Promoter contact information, identification information, tax information, payment and commission information, sales-performance information, sponsorship relationships, and related business records.

Certain Brand Ambassador contact and performance information may be made available within the applicable sponsorship organization as described by the separate Brand Ambassador agreements and Policies and Procedures.

MiCard does not treat those Brand Ambassador-specific sharing practices as an ordinary condition of using MiCard.io.

A User does not consent to Brand Ambassador sponsorship or downline information sharing merely by creating an ordinary MiCard.io account.

14. Employee and Authorized-Person Access

MiCard limits access to nonpublic personal information to personnel, contractors, and service providers who have a legitimate operational, support, security, compliance, or business need for the information.

Access may be subject to administrative, technical, contractual, or organizational safeguards appropriate to the nature of the information.

15. Data Security

MiCard uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, misuse, or destruction.

Depending on the information and system involved, safeguards may include:

  • access controls;
  • authentication measures;
  • secure transmission;
  • encryption where appropriate;
  • secure storage;
  • monitoring;
  • logging;
  • system-security controls;
  • password protection;
  • employee or contractor access restrictions;
  • security review; and
  • other measures appropriate to the sensitivity of the information.

No website, application, electronic transmission, storage system, or security measure can be guaranteed to be completely secure.

Users are also responsible for maintaining the confidentiality and security of their own account credentials.

16. Security Incidents

MiCard maintains procedures intended to respond to suspected or confirmed security incidents.

If MiCard determines that personal information has been affected by a security incident requiring notification under applicable law, MiCard will provide required notices to affected individuals, governmental authorities, or other parties in accordance with applicable legal requirements.

The form, timing, and content of any notice will depend on the circumstances and applicable law.

17. Data Retention

MiCard retains personal information for as long as reasonably necessary to:

  • provide the MiCard Services;
  • maintain an active account;
  • administer subscriptions;
  • fulfill the purposes described in this Privacy Policy;
  • comply with legal and regulatory requirements;
  • maintain business and financial records;
  • resolve disputes;
  • prevent fraud and abuse;
  • enforce agreements;
  • maintain security; and
  • establish, exercise, or defend legal claims.

Retention periods may vary depending on the nature of the information, the Service involved, the User's relationship with MiCard, and applicable legal requirements.

When personal information is no longer reasonably required, MiCard may delete, anonymize, aggregate, or otherwise dispose of it consistent with applicable law and operational requirements.

Backup systems may retain information for a limited period after deletion from active systems.

18. Account Cancellation and Deletion

Canceling a paid subscription and deleting a MiCard account are separate actions unless MiCard expressly states otherwise.

Cancellation of a subscription generally prevents future renewal but may not immediately delete the User's account or personal information.

Where account deletion functionality is available, Users may request deletion through the applicable account settings or by contacting MiCard.

Deletion requests remain subject to information MiCard is permitted or required to retain for legitimate business, security, financial, dispute-resolution, fraud-prevention, or legal purposes.

19. Your Privacy Choices

Depending on the MiCard Services you use, you may have options to:

  • access or update account information;
  • modify profile information;
  • control information displayed publicly;
  • manage communications preferences;
  • disconnect integrations;
  • cancel subscriptions;
  • request account deletion; and
  • exercise privacy rights available under applicable law.

Certain operational communications, such as security notices, transaction confirmations, billing notices, account notices, and material Service communications, may not be optional while an account or subscription remains active.

20. Marketing Communications

Where MiCard sends promotional or marketing emails, Users may opt out through the unsubscribe mechanism included in the communication or through available account preferences.

Opting out of marketing communications does not prevent MiCard from sending non-promotional communications concerning:

  • account administration;
  • transactions;
  • subscriptions;
  • billing;
  • security;
  • legal matters;
  • support requests; or
  • important changes to MiCard Services.

Requests to stop text messages or other communications will be honored as required by applicable law and the applicable communication program.

21. Privacy Rights

Depending on where you live, applicable privacy law may provide rights concerning your personal information.

Such rights may include the right to request:

  • access to personal information;
  • confirmation that MiCard processes your information;
  • correction of inaccurate personal information;
  • deletion of personal information;
  • a portable copy of certain information;
  • information concerning categories of personal information collected;
  • information concerning categories of recipients;
  • restriction of certain processing;
  • withdrawal of consent where processing is based on consent;
  • objection to certain processing; and
  • review of certain automated decisions where applicable.

Additional rights may apply under particular state, federal, or international privacy laws.

MiCard will not unlawfully discriminate against a User for exercising an applicable privacy right.

22. How to Submit a Privacy Request

MiCard may need to verify your identity before fulfilling certain requests.

Verification may require MiCard to compare information provided in the request with information already associated with the account.

MiCard may deny, limit, or charge a fee for a request where permitted by applicable law, including where a request is fraudulent, excessive, repetitive, technically infeasible, or would adversely affect the rights of another individual.

Where required, MiCard will explain the basis for denying a request and provide any available appeal process.

23. Authorized Agents

Where applicable law permits you to use an authorized agent to submit a privacy request, MiCard may require evidence that the agent has authority to act on your behalf.

MiCard may also require direct verification of your identity or confirmation that you authorized the request.

24. Information Concerning Minors

MiCard is intended for Users who are at least 14 years old.

MiCard does not knowingly permit children under 14 to create ordinary MiCard accounts.

If a User is under the age of legal majority where they reside, MiCard requires parental or legal-guardian authorization where required by the MiCard Terms of Service or applicable law.

Parents and legal guardians authorizing a minor's MiCard use should review the minor's account, privacy settings, public profile information, and use of MiCard Services.

A minor should not publish personal information through publicly accessible MiCard functionality that the minor or parent does not want publicly available.

If MiCard becomes aware that personal information was collected from a child who was not eligible to use MiCard, MiCard may take appropriate steps to restrict the account and delete the information, subject to applicable law and legitimate retention requirements.

25. Information About Other People

MiCard Services may allow Users to enter information concerning other individuals, including CRM contacts, prospects, customers, clients, colleagues, and networking contacts.

If you provide information concerning another individual, you represent that you have authority or another lawful basis to provide and use that information through MiCard.

MiCard Users are independently responsible for complying with laws governing their collection, use, storage, and communication of personal information concerning their own contacts.

MiCard Services may not be used to circumvent consent requirements, communication laws, privacy laws, or other legal restrictions.

26. International Users

MiCard may be accessible from jurisdictions outside the state or country where MiCard or its service providers maintain operations.

Accordingly, personal information may be processed in the United States or another jurisdiction where MiCard or its service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from the laws where you reside.

Where applicable law requires specific safeguards for international transfers of personal information, MiCard will use legally recognized mechanisms or protections appropriate to the transfer.

27. Third-Party Websites and Services

The MiCard Platform may contain links to or integrations with third-party websites, applications, products, or services.

MiCard is not responsible for the privacy practices of independent third parties.

When you leave the MiCard Platform or interact with a third-party service, that third party's privacy policy may govern its processing of your information.

You should review the applicable privacy policy before providing personal information to a third party.

28. Analytics, Advertising, and Tracking Technologies

MiCard may use analytics or similar technologies to understand Platform performance, usage, and engagement.

Any advertising, cross-context behavioral advertising, targeted advertising, sale, or sharing of personal information for advertising purposes will be handled in accordance with applicable law, including any required notice, consent, or opt-out rights.

Where legally required, MiCard will provide Users with an appropriate method to exercise applicable advertising or tracking choices.

29. Do Not Track and Preference Signals

Some browsers and devices allow Users to transmit privacy preference signals.

MiCard will recognize and respond to legally required browser-based or device-based privacy preference signals where applicable to MiCard's processing activities and where required by law.

Because standards and legal requirements concerning such signals may evolve, MiCard may update its practices as those requirements develop.

30. Business Records and De-Identified Information

MiCard may create aggregated, statistical, or de-identified information from information processed through the Platform.

Where information has been reasonably de-identified so that it is no longer considered personal information under applicable law, MiCard may use that information for lawful business purposes, including:

  • analytics;
  • research;
  • security;
  • product development;
  • Service improvement; and
  • business planning.

MiCard may also retain business records where necessary to document transactions, compliance, security events, contractual obligations, or legal matters.

31. Changes to This Privacy Policy

MiCard may update this Privacy Policy from time to time to reflect:

  • changes to MiCard Services;
  • new functionality;
  • changes in business practices;
  • changes in technology;

32. Disputes and Governing Terms

Questions concerning use of the MiCard Platform are also governed by the MiCard Terms of Service.

Nothing in this Privacy Policy limits any privacy right or remedy that cannot legally be waived.

If a separate agreement applies to a particular MiCard service, Brand Ambassador relationship, affiliate program, transaction, or other distinct activity, that agreement may contain additional provisions relevant to information processed in connection with that activity.
